Terms and conditions
1. General Conditions
The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as “you”) with Made In Transylvania SRL, hereinafter referred to as “Startonight”, “we”, or “us”, on the website startoshop.ro, on the mobile version of the website, via the mobile application, or by telephone (all collectively referred to as “startoshop.ro”).
By using startoshop.ro and/or placing an order, you agree to comply with the terms and conditions set out below (“the Terms”). Before placing an order, please ensure that you have read and understood these Terms.
Only natural persons who are at least 18 years old, are not under guardianship, do not act as legal entities, and who have residence or another address in Romania (excluding address forwarding companies) may place an order.
The inclusion of any products or services on startoshop.ro at any given time does not imply or guarantee that such products or services will always be available. We reserve the right to discontinue the sale of any product at any time.
We reserve the right to amend these Terms from time to time without prior notice. The Terms applicable to your order will be those displayed on startoshop.ro at the time the order is placed.
STARTONIGHT aims to provide the best possible online experience. To this end, we must ensure that our services function properly. You understand and agree:
(i) not to post, redistribute, upload, or promote any communications or content that could cause harm or negatively affect the company, our products, or our services;
(ii) not to act in any manner or use any device that restricts, interferes with, disrupts, or prevents any other user from using or benefiting from startoshop.ro, or that compromises the security of the website; and
(iii) not to use any device or attempt to use any engine, software, tool, agent, script, or other mechanism (including but not limited to spiders, bots, crawlers, avatars, or intelligent agents) to navigate or search the website or to copy content from the website.
We reserve the right to immediately block access to the website and close the account of any user who violates this provision or any other provision of these Terms and Conditions.
2. Prices and Delivery Charges
The prices displayed on startoshop.ro include the applicable value-added tax (VAT) but do not include delivery charges.
Orders are processed within a maximum of 3 business days from the date they are registered.
Delivery is carried out via the Sameday courier service, anywhere in Romania, within 24 hours from the date the parcel is dispatched. The shipping fee is RON 20 per shipment, regardless of the number of items in the order.
Sameday delivers to over 5,500 localities. If the delivery address is outside the courier’s coverage area, an additional fee for extra kilometers will apply.
3. Placing an Order / Conclusion of the Contract
Immediately after placing an order, if you have provided your email address, you will receive an order confirmation email. If, for any reason, we are unable to process your order, we will notify you as soon as possible.
If we have already received payment for your order, we will attempt to refund the amount using the same payment method used for the purchase. If alternative arrangements are required, we will inform you accordingly and ask you to contact STARTONIGHT Customer Service, who will process the refund.
4. Delivery
STARTONIGHT makes every reasonable effort to accept and process orders and will attempt to deliver your order to a residential address or another address in Romania, in accordance with the delivery option selected by you.
STARTONIGHT will endeavor to dispatch orders as quickly as possible and in the order in which they are received. Our aim is to deliver your order within 2 to 4 business days from confirmation. Before placing your order, you will be informed of the estimated delivery time.
Immediately after placing your order, if you have provided your email address, you will receive a confirmation email containing the estimated delivery date.

5. Order Cancellation or Returns
You may cancel or return your order from the date the order is placed until the 15th day after receiving the ordered items. If you have paid for these items, you will be refunded an amount that includes STARTONIGHT’s standard delivery charges, if such charges were applied. If you choose to keep certain items and cancel only part of the order, the delivery charge will not be refunded.

If you wish to cancel or return your order, please send us a written notice to office@startonight.ro and then return the item(s) in accordance with the provisions of Section 6 (Returns) below, within the 15-day period specified above.
We will attempt to process the refund using the same payment method used for the purchase (or, if the items have not yet been paid for, we will reflect the return in your account balance) as soon as possible, but no later than 14 days from the date we receive your cancellation notice, provided that we have received the returned items or proof that they have been returned. A different refund method may be used with your consent, at no additional cost to you.
If the item you received is defective or damaged, please contact us immediately at +40 745 033 763, and we will resolve the issue in your favor as quickly as possible.
6. Payment Methods
Credit or Debit Card
You may enter your payment details when placing your order using a valid credit or debit card (VISA or Mastercard). The corresponding amount will be immediately reserved on your card.
STARTONIGHT reserves the right to verify the validity of the credit or debit card, the available funds relative to the order value, and the accuracy of the buyer’s address details. Depending on the outcome of these checks, we may refuse certain orders.
Cash on Delivery
You may choose to pay in cash upon delivery when you receive the goods, at no additional cost.
You will receive the legally required invoice by email together with the Shipping Confirmation.
7. Our Liability
Nothing in these Terms shall exclude or limit STARTONIGHT’s liability in any matter where it would be unlawful to exclude or limit such liability.
STARTONIGHT accepts liability for death or personal injury caused by our negligence or that of our employees or representatives. We do not intend to exclude liability for false statements made by us or by our employees or representatives. In the event of a breach of these Terms, we shall be liable only for losses that are a reasonably foreseeable consequence of such breach.
STARTONIGHT shall not be liable for indirect losses that are a secondary consequence of the main loss or damage, such as loss of profit or loss of opportunity, or for failure to deliver goods or perform any of our obligations under these Terms where such failure is caused by events beyond our control, including but not limited to fire, flood, storm, riot, civil unrest, war, nuclear accident, or terrorist activity.
Our maximum liability to you for any loss or damage arising in connection with your order on startoshop.ro shall be limited to the total price of your order.
If you have a problem with a product purchased online from STARTONIGHT and have been unable to resolve the complaint directly with us, you may submit a complaint through the EU Online Dispute Resolution platform (“ODR platform”).
The ODR platform allows consumers and traders in the EU to seek alternative dispute resolution for complaints related to online purchases. This single point of contact is designed as an interactive and user-friendly website, available in all official EU languages and free of charge. Through the ODR platform, consumers and traders can identify a dispute resolution body and follow the procedure to resolve the complaint.

8. Colors
We make every effort to accurately display the characteristics of our products, including composition and colors. The colors you see depend on your computer system, and we cannot guarantee that your device will display colors accurately.
9. Warranty
If the goods you have purchased are defective, STARTONIGHT complies with all applicable legal warranty regulations. The warranty period is 24 months for natural persons and 12 months for legal entities.
10. Assignment
STARTONIGHT reserves the right to assign or transfer to third parties any claims for payment arising in connection with the delivery of goods.
11. Severability
If any provision of these Terms is deemed unlawful or unenforceable by any court or regulatory authority, the remaining provisions shall continue to apply.
12. Intellectual Property Rights
All intellectual property rights, such as trademarks and copyrights on startoshop.ro, belong to Made In Transylvania SRL. Any use of the website or its content, including copying or storing all or part of the content for purposes other than personal, non-commercial use, is prohibited without STARTONIGHT’s permission.
